Anthropic Wins Against Pentagon as Court Rules Blacklist Illegal, Clearing Key Hurdle Ahead of IPO

TradingKey - On August 27 ET, the U.S. District Court for the Northern District of California ruled that the Pentagon's placement of Anthropic on a "supply chain risk" blacklist was "unlawful and unfounded." This clash between AI ethics and government power ended in a phased victory for Anthropic.

This timing closely overlaps with Anthropic's IPO process, as the company is sprinting toward the largest IPO in global history, with valuation expectations from some core investors reaching $2 trillion.

Anthropic and the Pentagon: How AI Ethical Red Lines Ignited a Dispute?

The dispute stems from a fundamental disagreement between Anthropic and the Pentagon over the boundaries of AI usage. As the developer of Claude AI, Anthropic explicitly set two non-negotiable red lines: prohibiting the use of its technology in autonomous weapon systems and for mass surveillance within the United States. Anthropic believes AI models are not yet safe enough for deployment in autonomous weapons; meanwhile, the company firmly opposes any surveillance activities that infringe upon civil liberties.

The Pentagon, on the other hand, insisted that military procurement should not be subject to unilateral restrictions by private companies, demanding that Anthropic allow unrestricted use of Claude under "all lawful purposes."

Following the collapse of negotiations, U.S. Secretary of Defense Hegseth designated Anthropic as a "national security supply chain risk" entity in late February 2026. The U.S. had never previously placed a domestic company on the supply chain risk list under this procurement law, which was designed to guard against sabotage by foreign powers.

Anthropic Wins as Court Rules Pentagon Retaliation Unconstitutional

Anthropic filed a lawsuit in March 2026, alleging that the government violated its First Amendment free speech rights and Fifth Amendment due process rights. In a 59-page ruling, Judge Rita Lin noted that the Pentagon's actions were "unlawful retaliation" for Anthropic's public criticism of government AI policy.

Judge Lin emphasized: "A vague invocation of national security does not mean the government can arbitrarily punish and retaliate against critics."

The ruling also noted that multiple government agencies, including the State Department, continued doing business with Anthropic after the blacklist was issued, which "is completely at odds with assertions of a genuine concern that Anthropic would compromise national security."

Anthropic IPO Targets Trillion-Dollar Valuation, Could Become Largest IPO in History

Anthropic completed a $65 billion Series H funding round at the end of May 2026, reaching a post-money valuation of $965 billion. The company is currently advancing its IPO preparations.

According to a report by The Information, Anthropic plans to publish its prospectus after US Labor Day (September 7) and may officially debut on the US stock market in late September or early October.

People familiar with the matter revealed that the company expects to hold an investor event in mid-September to engage further with potential institutional investors, though the final listing timeline may still be adjusted based on market conditions.

Market expectations are that its IPO valuation will reach $2 trillion or higher, which, if realized, would break the $1.77 trillion IPO record set by SpaceX in June 2026.

Underpinning this valuation is Anthropic's rapid growth: its annualized revenue grew from approximately $14 billion in February 2026 to $47 billion in May, with investors expecting it to reach $100 billion to $120 billion by the end of the year.

Against this backdrop, the legal dispute with the Pentagon was once an unresolved risk factor. Anthropic had previously warned that being blacklisted could result in billions of dollars in lost business and reputational damage.

This court ruling clears policy obstacles for Anthropic to cooperate directly with the Department of Defense, offering hope for reopening previously severed government business channels.

Beyond Court Victory, Unresolved Risks Remain

Anthropic's victory is not complete. The company's lawsuit in Washington, D.C., challenging another supply chain risk designation by the Department of Defense remains ongoing, and related measures could further exclude Anthropic from federal civilian contracts. The U.S. government may also appeal the California ruling.

However, this ruling has established an important precedent: the court explicitly affirmed that AI companies have the right to set usage boundaries for their technology based on safety and ethical considerations, and that the government cannot engage in retaliation under the guise of national security. For Anthropic, which is preparing to go public, the long-term value of this victory may be no less than its financial performance.
